Here are 10 red flags every buyer should know.
1. No Clean Title
Always verify the Transfer Certificate of Title (TCT) or Condominium Certificate of Title (CCT) at the Registry of Deeds. If the seller can't produce a clean title, walk away.
2. Unpaid Real Property Taxes
Check with the local assessor's office if the property has any unpaid RPT. These become your liability upon transfer.
3. Pressure to Decide Immediately
Legitimate sellers and agents give you time to think. Anyone pressuring you to "close today or lose the deal" is a red flag.
4. Too Good to Be True Pricing
Significantly below-market prices often signal title issues, structural problems, or legal disputes. Do your homework.
5. No Written Contract
Everything must be in writing. Verbal agreements are unenforceable and risky. Refuse any deal that doesn't offer a formal Contract to Sell or Deed of Absolute Sale.
6. Multiple Claims on the Property
Ask if anyone else has a claim, lien, or encumbrance on the property. A title search will reveal this.
7. Unlicensed Agents or Brokers
Under Philippine law (RA 9646), only PRC-licensed real estate brokers and registered salespersons may facilitate property transactions. Always verify credentials.
8. No Physical Inspection Allowed
If a seller won't let you visit the property in person, something's wrong.
9. Vague Developer History
If buying from a developer, research their track record. Delayed turnover, abandoned projects, and poor construction are real risks with fly-by-night developers.
10. Misrepresentation of Location or Amenities
Always verify what you're told. Visit the area, check flood maps (PHIVOLCS and PAGASA have resources), and confirm that advertised amenities actually exist.
